What a notice must include

  • Your physical or electronic signature.
  • The copyrighted work you say is infringed.
  • The infringing material and where it is: the shop’s address and the exact page.
  • Your name, postal address, phone number and email.
  • A statement that you believe in good faith the use isn’t authorised by the owner, its agent or the law.
  • A statement that the notice is accurate and, under penalty of perjury, that you are the owner or may act for them.

Other ways to tell us

You can also use our report form and choose “Counterfeit goods or intellectual property”. For trademarks and other rights, the report form is the place.

What we do

We send you a receipt. When a notice has everything listed here, we disable the product, page, file or shop it names, usually within one to two business days, and email the store owner what we disabled, why, and how to send a counter-notice. Then we tell you what we did.

Counter-notices

A store owner who believes the material was disabled by mistake or misidentification can send a counter-notice from Admin. It must include their name, address, phone number and email, a statement under penalty of perjury that they believe in good faith it was a mistake, their consent to the federal court for their address (or, outside the US, any court where we can be found), and their signature. We send you a copy. Unless you tell us within 10 business days that you have filed a court action to stop the infringement, we restore the material 10 to 14 business days after we received the counter-notice.

Repeat infringers

Three upheld notices against an owner within 12 months end their account, and we take their stores offline. Notices that are withdrawn, found invalid, or answered by a counter-notice after which we restored the material don’t count. We keep these records for three years. Our Acceptable Use Policy (§4 and §5) has the details, including how an owner can ask us to review a decision.
