Shop terms of sale template

Draft for legal review, version 2026-10-11-draft. Not in effect. A starting point for store owners, not legal advice. Copy it into your shop, replace everything in [square brackets], delete what doesn't apply, and have it checked: consumer law differs a lot between countries.

Terms of Sale

Last updated: [date]

These terms apply when you buy from [shop name] at [shop address on the web]. Sold by [legal business name], [registration number], [postal address] ("we"), the seller of everything in this shop. Contact us at [email] [phone].

Who you buy from

Your contract is with us. The shop runs on store software from SBCommerce.net (Stonebridge Digital LLC), which is not the seller, not a party to your purchase and never receives your payment. Questions about orders, payments, refunds and warranties come to us.

Orders

Your order is an offer to buy. We accept it when we send the order confirmation email. If an item turns out to be unavailable, we tell you and refund anything you paid.

Your account

You must be at least 16 to create an account in this shop. Keep access to your email safe: it is how you sign in. [Delete this section if your shop doesn't use accounts.]

Prices and payment

Prices are in [currency] and [include / don't include] [VAT / sales tax]. Delivery costs are shown before you pay. Payments are processed by [payment provider, such as Stripe or PayPal] into our own account, under its terms. [If a merchant of record such as Creem or Dodo Payments takes the payment, it sells to you in its own name and its terms also apply.]

Delivery

We deliver to [countries] within [time]. [Who pays customs and import duties.] The risk passes to you when the order is delivered.

Digital products

Downloads are available right after payment, for [number] days and up to [number] downloads. [With a merchant of record: Buyers who live in the EU, EEA or UK buy downloads only through [Creem / Dodo Payments], which sells them in its own name. Without one: We don't sell downloads to buyers who live in the EU, EEA or UK.] [In the EU and UK: at checkout you can tick a box to ask for the download to start at once and to acknowledge that you then lose your 14-day right to cancel; we confirm it in your order email. If you don't tick it, you keep the 14 days.]

Bookings

[How to cancel or move a booking, how much notice is needed, and what is refunded.]

Returns and cancellation

[EU and UK consumers can cancel most online purchases within 14 days of delivery, without giving a reason. Describe how to tell you, who pays return postage, and that you refund within 14 days.] [Items that can't be returned, such as made-to-order or sealed hygiene goods.]

[EU, EEA and UK sellers: You can also withdraw from your contract online, using our withdrawal function ("Withdraw from contract here") at [your shop address]/withdraw.]

Faulty items

If something arrives faulty or not as described, contact us at [email] and we will repair, replace or refund it, as the law gives you.

Liability

Nothing here limits your rights as a consumer under the law. [Any other limits, as allowed in your country.]

Law and disputes

These terms are governed by the law of [country]. [EU and UK consumers also keep the protection of the mandatory law of the country where they live, and can use their local courts.]
